Who may use our site and services

These terms of use set out your rights and obligations when using our website, platform and services.

By using our website, you agree to these terms of use.  If you don’t agree to these terms, you must not use our site. 

Our website and the services we provide through our website are not for use by anyone under the age of 16.

If you use our website or any service on behalf of a business or institution (e.g. colleges and universities), that business or institution agrees to these terms. If someone else accesses our website through your internet connection, you are responsible for ensuring that they are aware of these terms and comply with them.

Who we are

We’re Prodigies Limited and we’re a company registered in England and Wales under company number 15184778. 

We created our site to enable creatives to showcase their work, connect with one another and find opportunities with other creatives, agencies, brands and institutions.  We also allow agencies, employers, hirers and institutions (“organisations”) to seek out creatives suitable for a particular project, contract or role.    

In these terms of use, individual account holders are referred to as “creative members”.  In future we will enable accounts for organisations.  An organisation with an account is referred to as a “business member”.

We also allow visitors to view our website and use some services.  Together, visitors, creative members and business members are referred to as “users” in these terms of use.

Our terms of use apply to everyone who uses our website, but in places we have highlighted terms that apply specifically to creative members, organisations or business members.  They set out the rules for your membership account with us, how you use it, how your content is treated, what you can do with other content and what we can do with content and information you upload.

When we refer to “content” in these terms, we mean anything available through our services, whether provided directly by us or uploaded by users, including:

  • Text
  • Audio (including voice, sounds and music)
  • Video
  • Images
  • Software
  • Meta-data and code (including open-source code)
  • Anything else made by members and uploaded to our services.

Other terms that also apply to you

These terms of use should be read in conjunction with our Privacy Policy and Cookie Policy. 

We will only use your personal information as set out in the Privacy Policy.

Please remember that we have the right to disclose your identity to anyone who claims that content you have uploaded to our website breaches (1) their rights in that content, or (2) their right to privacy.

Additional terms may apply for some services or events such as competitions – we will always let you know if this is the case.

Our services

Our services include:

  • Providing our website and making our content available to you, including limited access for all users and extended access for creative members
  • Free creative memberships and accounts with log-in details
  • Self-serve creation and display of portfolios (including content owned by creative members), bios, skills and images
  • Content management in accordance with these terms
  • Business partner pages
  • We will notify you when our advanced search function and on platform messaging for members launches

Our services for creative members are currently made available free of charge. 

Now and again we will update and make changes to our website and our services, so it may not always look the same or work the same way as before.

Sometimes we might have to suspend or withdraw our website or a service (or part of our website or a service).  We’ll try to let you know before this happens, but we might not always be able to and we can’t guarantee that the website, services or any content will be available to you.

Content on our website (other than these terms of use and other terms and policies referred to in these terms of use) is provided to you for general information only.  It is your responsibility to check information before you make any decision based on the content.  We’re not obliged to make sure the website is up to date and we can’t and don’t make any promise to you that any content or information is up to date, accurate or complete at any time.

Creative member accounts

You’ll be asked to confirm that you have read and understood these terms of use and the privacy policy before you can sign up to be a member. 

Creating an account

When you create an account, you must be a real person with one account in your own name.  If we suspect an account has been created by bots or that an individual or organisation has created multiple accounts, or accounts for someone else, we may suspend, terminate or delete accounts, bios and all content in the associated portfolios without notice. 

When you create an account you have to tell us your real name and a genuine contact for your user name or display name, your display name can be change on your profile.

If you set up an account with a username that we consider offensive, we may delete it and  allocate a new user name to you.

It is important that the personal data we hold about you is accurate and current. Please keep us informed if your personal data changes during your relationship with us, for example a new address or email address.

We might contact you.  How and when we might contact you is set out in our privacy policy.

Security

You have to keep your log in details (username and password) safe and keep them secret.  If you fail to do so, or if in our reasonable opinion you have failed to comply with any of these terms of use, we may disable your password.

If you become aware of or reasonably suspect that anyone else knows your log-in details, you must contact us immediately at hello@prodigiesofficial.com

Bio

All of the information that you upload to your bio must be true.  You must not claim that you have skills that you do not have, or that you own something that belongs to someone else.

Anything you write in your bio must be your own words.  It must not be copied or otherwise appropriated from anyone or from anything that belongs to someone else.

You may only add links to websites and apps using the functions provided for you.  When you link to social media, the link must be to your account and not someone else’s account. Further terms on linking for all users are set out later in these terms.

Portfolio

We do not pay you for content uploaded to our site.

Anything you upload to your content or write in your bio must be your own.  It must not be copied or otherwise appropriated from anyone or from anything that belongs to someone else.

Your content must not contain any element of anyone else’s work unless that person has given you clear written permission to use it in the way you have used it and to upload it to our website for use in your portfolio.  If you upload anything belonging to someone else and they claim royalties or other payments from you, you are responsible for those payments and not us.  If we are asked to make payments, you agree to reimburse us in full for the payments and any other costs we incur. 

You may not upload content containing elements of work belonging to another creative member or that is a collaborative work with another creative member unless you have a written agreement or permission from them to upload it to your portfolio.  You must clearly label content created in collaboration with another creative member and content featuring the work of another creative member, including tagging them. 

We may require you to provide us with a copy of any permission you have to use someone else’s work, or to provide your explanation for why you believe you have the right to use their work without a specific written permission.

If you have given another creative member written permission to upload content you may not withdraw that permission unless you have written to them and us identifying the content and confirming that you are withdrawing permission.  They will then have ninety days to remove the relevant content.

We don’t guarantee that an upload will work, or that it will work in any particular size or format.  Files may be compressed or otherwise altered as art of the uploading process and we cannot guarantee that the uploaded content will be of the same quality and appearance as the original.  If you are unhappy with an upload, please delete it and try alternative content.

Rights you give us to use your content

When you upload your content to our site, you give us the rights to edit it and you won’t be able to claim that we have treated it in a “derogatory” way.  We don’t have to identify you as the creator in every use – we usually will where it is consistent with the purpose of the site and contact you regarding it, but sometimes it might not be practical where things like banners and marketing materials don’t allow for it.

You also give us the rights over content uploaded:

  • to feature it on our site
  • to edit it (for example, our tech re-sizing it or showing a part of the work on your profile)
  • to store it on our servers
  • to use it in providing our services
  • to use it in our marketing materials and social media, either on its own (in whole or in part) or together with other content

Anything you upload to your bio or portfolio is made available publicly, so it will not be confidential.  Do not include any information that you want to remain confidential, or which you are otherwise required to keep confidential (e.g. by agreement with someone else).

Protecting your work

We recommend that you watermark anything you upload to your portfolio that you own all the rights to with “Copyright” or “©” followed by your name and the year the work was first published.  For example, our copyright notice is © Prodigies Limited 2024.  It is your responsibility to ensure that you own all the rights in anything you upload.  If you are in any doubt, don’t upload the image and take advice from an independent advisor – we do not give advice on intellectual property rights.

We are not responsible for loss of content or other data uploaded to our site if something goes wrong with our website or our services.  We cannot guarantee that we will be able to recover any data or other content that you upload to our site.  You are responsible for keeping backups of any information you upload to our site.    

Responsible bios and portfolios

You must not add or upload any content that:

  • is illegal, such as incitement of violence or terrorism, hate speech or breaking privacy laws
  • you do not have the right to upload
  • might harass or upset people, is unfair or unkind
  • contains anything offensive or obscene
  • is racist, sexist, ableist or otherwise discriminatory
  • is insulting, misleading or defamatory
  • promotes pornography, tobacco, alcohol, illegal drugs or weapons
  • puts children at risk
  • could damage our reputation
  • is not in accordance with these terms

We provide our services to connect creatives with each other, brands, agencies, institutions, and opportunities to collaborate with one another, share portfolios, improve their skills and advance their careers.  Our website is not a forum to make controversial statements (artistic or not), nor to vent frustrations with the wider world.  Social media is the home for debate – we just provide a positive place for you to network and showcase your work.

Think carefully about what you upload and remember that your bio is there to promote your skills and abilities to organisations and hirers.    

You must not make any unfair or unkind comment in relation to other creative members’ work. 

You must not write or upload anything that harms the reputation of another person, company or other organisation, or comment on an active lawsuit.  If you do so, you risk being sued or other legal remedies, like injunction - and you risk including us.  If we are affected, we may take legal action against you.

We may (but are not obliged to) moderate content.  This means we can review it and decline to publish it, publish it in edited form or remove it after it has been uploaded and/or published.  At the moment, any review is a human review.  If we introduce reviews using AI tools, we will update these terms before we use them.

You warrant that you will comply with these standards.  If any content that you upload to our website, your bio or portfolio does not comply with these standards, you will be responsible to us for any and all loss or damage we suffer as a result. 

No guarantee of work

We don’t guarantee that you will find work, or that you will appear in any particular order in search results.

Take Down, Suspension and Termination

If you don’t follow these terms, you might find your account and use of the services is suspended or terminated.

If this happens, your content, profile and anything else you upload or post to our website could be deleted. 

We may not have a back-up copy of deleted content, bios, portfolios or profiles, so if we lift a suspension or allow you to re-join you will have to create a new profile (including bio and portfolio) from scratch.

If we restrict access to any content you upload to your portfolio in a way that breaches these terms of use, you have the right to bring a claim against us for breach of contract.

Our site, our name, our services and our content

“Prodigies” is a UK registered trademark of Prodigies Limited.  We are the owner or the licensee of all intellectual property rights in our website. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.

We do not grant you any rights to use our name, branding, trademarks or logos without our permission.  This includes press releases that we have not approved in writing in advance.  If you want to use our name, branding, trademarks, logo, or any content on our website, you must get our permission in writing before you use them and for every instance that you use them. 

Much of the content on our website belongs to others and is licensed to us, such as content uploaded by members.  If you want to use their content, you’ll need to ask them for permission.  There may be a fee to pay.

If you are authorised to use any content featuring a copyright notice, you must retain the copyright notice unaltered and always let the owner know.

You must not imply that you are authorised to do anything on our behalf, or that we endorse you or otherwise approve or you or your work unless we have given you written permission.  If we have given you permission, you must comply with any terms of that permission. 

You must not copy or recreate our website or services, including the structure, layout, branding, feel and design of our website and services or try to make money from our website and services or anything contained in or uploaded to them, such as charging other people to access our services or using our name, branding or content in marketing and advertising.  As a limited exception to this, you may print off one copy, and may download extracts, of any page(s) from our website for your personal use and if you’re a business an institution or a student at an educational institution you may draw the attention of others within your organisation to content posted on our website.  You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text. You must not use any content printed or downloaded for any commercial purpose (e.g. to sell it or use it to promote any person, business, concept or item).  Our status and that of any other owner, including creative members, as the authors of content on our website must always be acknowledged.

You may not copy or download any complete database or substantial portion of it. Databases on the website include (without limitation) lists of members and their logos, profiles and contact details.

If a user posts or uploads their view on any matter to this website or any service, their views are their own and do not necessarily reflect our views.  If a user uploads content, that does not imply that we endorse that content.

If you print off, copy, download, share or repost any part of our website in breach of these terms of use, your right to use our site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.

Linking

If you click on links to other sites or social media apps, the terms of use for use of those sites and apps will apply.  We don’t endorse those sites or apps and have no control over them.  Links are provided for your information only.

You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it. You must not establish a link to our website in any website that is not owned by you. Our website must not be framed on any other website.

You must not establish a link in such a way as to suggest any form of association, approval or endorsement from us.

We reserve the right to withdraw linking permission without notice.

Viruses and misuse

We do not guarantee that our website and services will be secure or free from bugs or viruses.  You should use your own virus protection software.  You are responsible for configuring your information technology, computer programmes and platform to access our website.

You must not:

  • attempt to circumvent our content security technology.
  • take any action that imposes an unreasonable or disproportionately large load on our network or infrastructure.
  • misuse our website by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful.
  • attempt to gain unauthorised access to (e.g., by hacking) our website, the server on which our website is stored or any server, computer or database connected to our website.
  • attack our website via a denial-of-service attack or a distributed denial-of service attack.

By breaching this term, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them.

If you do any of the things listed in this term, your right to use our website will cease immediately.

Text-mining, web-scraping and unauthorised uses

You must not use any content, code or technical element of our website or services for (1) the development of any software program, including, but not limited to, training a machine learning or artificial intelligence (AI) system; or (2) providing archived or cached data sets containing content or code to another person or entity.

You must not conduct, facilitate, authorise or permit any text or data mining or web-scraping in relation to our website or services. This includes manually scaping information from the website and using (or permitting, authorising or attempting the use of) any "robot", "bot", "spider", "scraper" or other automated device, program, tool, algorithm, code, process or methodology to access, obtain, copy, monitor or republish any portion of the website or any data, content, information or services, or any automated analytical technique aimed at analysing text and data in digital form to generate information which includes but is not limited to patterns, trends and correlations.

This term should be treated as an express reservation of our rights in this regard, including for the purposes of Article 4(3) of Digital Copyright Directive ((EU) 2019/790).

This term shall not apply insofar as (but only to the extent that) we are unable to exclude or limit text or data mining or web scraping activity by contract under the laws which are applicable to us.

Our responsibility for loss or damage suffered by you

All users

We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation.

Businesses

We exclude all implied conditions, warranties, representations or other terms that may apply to our website or any content on it.

We will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:

  • use of, or inability to use, our site; or
  • use of or reliance on any content displayed on our site.

In particular, we will not be liable for:

  • loss of profits, sales, business, or revenue;
  • business interruption;
  • loss of anticipated savings;
  • loss of business opportunity, goodwill or reputation; or
  • any indirect or consequential loss or damage.

Consumers

We only provide our website to you for domestic and private use. You agree not to use our website for any commercial or business purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

Complaints and reporting content

If you become aware of any:

  • illegal or offensive content
  • unauthorised use of intellectual property rights, or
  • content that is otherwise in breach of these terms of use

If you frequently submit notices or complaints that are clearly unfounded, we may suspend the processing of any further notices or complaints from you for a reasonable period of time. We will warn you in advance if we propose to suspend processing of your notices or complaints.

When deciding whether to suspend you, we will consider:

• how many items of clearly unfounded notices or complaints you submitted within a given time frame in terms of the volume of other notices or complaints submitted by other users during that time

• the gravity of the misuse

• where possible to identify, your intention in submitting the notices or complaints.

Suspension and bans

If we suspend or ban you from using our website or services in a way that breaches these terms of us, you have the right to bring a claim against us for breach of contract.

Transfer of this agreement to someone else

This is a contract between you and us.  No one else has any rights to enforce its terms unless we have specifically said they do in these terms.

You can’t transfer your rights and obligations to anyone else, but we may transfer our rights and obligations to someone else.  If we do, we will let you know and will make sure that the transfer does not affect your rights under these terms of use.

Governing law

These terms are governed by English law.  Only English courts can make judgements about them.

Changes to This Policy

We keep our Terms of Use under regular review. Now and again we will introduce new services or change the services we already provide through our website.  When this happens, or there are changes outside our control (e.g. to a law or regulation), we will update these terms. 

We’ll tell you when we update our terms, by email, internal message or pop-up notice. If you don’t agree with the changes, you may close your membership account and stop using our website and our services. 

Changes only apply after the stated effective date.

Previous terms

These terms of use and any other terms we have told you about replace all previous agreements between you and us relating to our website, our services and the content on them.
